Traffic conditions

These traffic conditions ("Traffic conditions") supplement the General Terms and Conditions ("Conditions") of OMG Robotics sro, with its registered office at Tyršova 2671/45, Královo Pole, 61200 Brno, Czech Republic, IČO: 17909511, DIČ: CZ17909511, file no. C 132065, registered at the Regional Court in Brno, ("Seller") and thus forms part of the Purchase Agreement as defined in the Conditions. Capitalized terms in these Conditions of Carriage have the meaning assigned to them in the Conditions, unless expressly provided otherwise in these Conditions of Carriage.

These Transport Conditions govern the rules for the transport of goods based on Orders placed through the Seller's online store.

Transportation and shipping 

  1. The Seller uses one or more third-party commercial delivery services ("Third Party Delivery Services") to transport the Goods to the Buyer.Carrier").
  2. At the Buyer's express request, it is possible to arrange a non-standard method of transport (e.g. express delivery, evening delivery, delivery with return, time slots). In such a case, the Buyer bears the additional costs and risks associated with this method of transport.
  3. In the event that the Seller offers free shipping of goods, the prerequisite for the right to free shipping of goods is the payment of the minimum total purchase price of the transported goods in the amount specified on the Website by the Buyer. In the event that the Buyer partially withdraws from the Purchase Agreement and the total purchase price of the goods for which the Buyer has not withdrawn from the Purchase Agreement does not reach the minimum amount required for the right to free shipping of goods pursuant to the previous sentence, the Buyer's right to free shipping of goods ceases and the Buyer is obliged to pay the Seller for the shipping of goods.
  4. Unless otherwise stated for a specific good, the Seller will make all reasonable efforts to ship and deliver the goods within the dates specified on the Website, but no later than 30 days from the conclusion of the Purchase Agreement.
  5. Conditions for dispatch: (a) availability of goods in stock in the ordered quantity; and (b) payment of the purchase price or fulfillment of the agreed payment terms (does not apply to cash on delivery, if offered).
  6. If circumstances arise that prevent delivery within the specified deadline (e.g. stock shortage, force majeure), the Seller will inform the Buyer without undue delay.

Delivery and receipt of the shipment

  1. The goods are delivered to the delivery address specified by the Buyer in the order. The Buyer is obliged to take delivery of the goods at the place of delivery.
  2. The goods are considered delivered at the moment of their receipt by the Buyer from the Carrier.
  3. Changing the delivery address after sending the shipment is only possible if the selected Carrier allows it and the Buyer will pay any related costs.

Checking the shipment upon receipt

  1. Upon receipt from the Carrier, the Buyer is obliged to check the integrity of the packaging and the number of packages and to immediately inform the Carrier in the event of any defects or discrepancies.
  2. If the packaging of the shipment is obviously damaged in a way that indicates unauthorized entry, the Buyer is not obliged to accept the shipment. This does not affect the Buyer's rights from liability for defects in goods and other rights of the Buyer arising from generally binding legal regulations.

Non-acceptance of shipment, repeated delivery and storage

  1. If the shipment is not delivered for reasons on the Buyer's side (e.g. incorrect address, repeated failure to arrive, refusal to accept without legal reason), the Buyer shall pay the costs associated with repeated delivery.
  2. The Seller is entitled to sell the goods in a reasonable manner if the Buyer does not accept the goods even after prior demonstrable notification by e-mail and provision of a new reasonable delivery time.
  3. The amount will be refunded to the Buyer from the proceeds of the sale after deducting the Seller's costs (e.g. for storage, transport and other reasonably incurred costs) incurred by the Seller as a result of the Buyer's breach of the obligation to take over the goods.

International transport

  1. Information about the costs associated with packaging and delivery of goods provided on the Website applies only in cases where the goods are delivered within the territory of the Czech Republic.
  2. Delivery to EU or non-EU countries is possible if this option is listed on the Website or agreed individually.
  3. Delivery times for international shipping may vary depending on customs clearance and distance.

Final Provisions

  1. If any issues are not regulated in these Conditions of Carriage, the Conditions shall apply.
  2. In the event of a conflict between the Terms and Conditions and the Transport Terms, the Transport Terms shall prevail for matters of transport and delivery of goods.

Payment Terms

C 132065, registered at the Regional Court in Brno, ("Seller") and thus forms part of the Purchase Agreement as defined in the Terms. Capitalized terms in these Payment Terms have the meaning given in the Terms, unless expressly provided otherwise in these Payment Terms.

These Payment Terms govern the rules for the transportation of goods based on Orders placed through the Seller's online store.

Payment of the purchase price and terms of shipment of goods

  1. The Buyer is obliged to pay the Seller, together with the purchase price, the costs associated with packaging and delivery of the goods in the agreed amount. It is not-Unless expressly stated otherwise below, the purchase price also includes the costs associated with the delivery of the goods.
  2. The buyer is obliged to pay the purchase price before the goods are dispatched, this does not apply, it is-If cash on delivery service has been arranged, the goods will only be shipped after the purchase price has been paid in full.
  3. The Buyer's obligation to pay the purchase price is fulfilled when the relevant amount is credited to the Seller's account or by paying in cash upon personal collection of the goods.

Method of payment of the purchase price 

  1. The Buyer may pay the purchase price to the Seller in one of the following ways (depending on the Buyer's choice and the actual availability of such a payment method in the Seller's online store):
    1.1. by bank transfer to the Seller's bank account 2002567288/2010 ;
    1.2. cashless by payment card – the Buyer will pay the purchase price immediately after placing the Order via the payment gateway located on the Seller's Website;
    1.3. cash on delivery, i.e. in cash upon receipt of the goods from the carrier. 

Deposits and prepayment

  1. The Seller does not require a deposit or other similar payment. This does not affect the provisions of Article 4.2 regarding the obligation to pay the purchase price of the goods in advance.
  2. The Seller is entitled, in particular in the event that the Buyer does not subsequently confirm the Order pursuant to Article 2.8 of the Terms and Conditions, to demand payment of the entire purchase price before dispatch of the goods. The provisions of Section 2119, paragraph 1 of the Civil Code shall not apply.

Tax documents

  1. Je-if it is customary in business dealings or is-If required by law, the Seller will issue a tax document - invoice for the payment made under the Purchase Agreement.
  2. The seller is a VAT payer. He issues an invoice after payment of the price of the goods and sends it in electronic form to e-the Buyer's email address specified in the Order.

Discounts

  1. Discounts on the purchase price provided by the Seller to the Buyer cannot be combined with each other, unless otherwise specified by the Seller.

Final Provisions

  1. If some issues are not regulated in these Payment Terms, the Terms and Conditions shall apply.
  2. In the event of a conflict between the Terms and Conditions and the Payment Terms, the Payment Terms shall prevail for payment issues and reimbursement of the purchase price.
